Long-Term Care Partnership

Long-Term Care Partnership explores the provisions, requirements, advantages and disadvantages of the long-term care partnership program. It discusses the types of assets that Medicaid considers exempt and non-exempt for eligibility purposes, looks at the estate recovery process applicable to Medicaid decedents, and explains how a long-term care partnership plan shields a participant’s assets from estate recovery. Additionally, it examines the protections put in place to protect consumers when purchasing tax-qualified long-term care insurance and the required suitability standards that insurers must develop and to which their agents are required to adhere.

Upon completion, a student should be able to:

  • Describe the role of Medicaid in funding long-term care services;
  • Recognize the types of assets considered exempt and non-exempt for purposes of Medicaid eligibility:
  • Describe Medicaid’s estate recovery process;  
  • Explain how much of a Medicaid long-term care participant’s assets are shielded from estate recovery;
  • Identify the benefit triggers in a tax-qualified long-term care insurance policy;
  • Describe the consumer protection requirements related to the sale of a tax-qualified long-term care policy; 
  • Identify the training agents must take before they are permitted to sell long-term care insurance; and
  • Explain the insurers’ requirements to develop and use suitability standards.
